It is important that Have Your Say content is written in plain English and style, grammar and other language conventions are consistent.

Please use the following guidance when drafting content:

All NSW Government consultations must be listed on the Have Your Say central portal.

As per a Premier's Memorandum, NSW Government departments and agencies are required to list any public consultation that they are conducting on the central portal, Have Your Say.

Put in a request via the nsw.gov.au help hub to get a tile on the Have Your Say homepage. Please give the web team a minimum of two business days to turn around your request.

The NSW Government promotes all public consultations on the Have Your Say central portal.

If you visit this website, you’ll be able to find most NSW Government consultations that are currently open and publicly available.

This page is not managed by the DCS Have Your Say team. It is owned and managed by the nsw.gov.au team. Any NSW Government organisation can request that their consultation is added to it via the nsw.gov.au help hub.

Not all of the consultations you find there have been created from a partnership with the Have Your Say team so they are sometimes inconsistent in style and content.

Please ensure you follow your department's relevant approvals processes before publishing any content. If you're not sure what they are, speak with your manager or the key engagement contact for your department.


Important privacy and data governance information

All departments must comply with the following data governance and privacy requirements:

If you are collecting personal information, you need a privacy collection notice (PCN).

A PCN is a requirement under NSW privacy law for each Have Your Say consultation page that collects personal information. Personal information is broad and includes a person’s name, email, address or phone number.

A PCN is a statement to an individual when an agency collects personal information from them. It tells the person what personal information is being collected, how it will be used, and to whom it will be disclosed.

A PCN is different to a privacy statement, policy or plan, and must be created regardless of the existence of these types of documents.

The sitewide Have Your Say privacy policy is located here haveyoursay.nsw.gov.au/privacy-policy and is different from a PCN.

There are six requirements in a privacy collection notice. You must tell the person:
  1. You are collecting their personal and/or health information
  2. The purpose/s you are collecting it for
  3. The intended recipients of the information
  4. Whether the supply of information is voluntary or lawfully required, and any consequences if the person does not provide the information.
  5. How to access and correct the information being collected
  6. The name and address of the agency collecting the information, and the agency (if different) who will hold the information.

These are legal requirements under section 10 of the PPIP Act.

Top tips for writing a PCN

  • Use plain English
  • Include the six requirements listed above
  • Be clear and transparent about how the information will be handled
  • Tailor your notice to the circumstances - don't cut and paste because the way you are collecting and using information is probably different!
  • If in doubt about the content of your collection notice, you can seek advice from your department/agency's privacy contact.
It is each department or agency's responsibility to ensure an appropriate PCN is included on the Have Your Say consultations they are managing.

All consultations collecting any personal information must ensure that:

  • an appropriate PCN is prepared for each consultation and is available on the page.
  • The PCN complies with section 10 of the PPIP Act.

Personal information collection
  • Ensure you minimise personal information collection and only collect information which is necessary for the intended purpose.
  • Where appropriate, expressly advise stakeholders not to provide personal information
Anonymity
  • Offer stakeholders the option to engage anonymously especially in sensitive contexts.
Information sharing
  • Always transfer files/reports securely using Kiteworks (or other file sharing platforms approved by your department). Never use email.
Data sharing and third parties
  • Always consider what personal information will be collected through the consultation and if it needs to be shared with external parties.
  • Also consider if you are collaborating with another government department. These details should be captured in your Privacy Collection Notice.
Submissions
  • If your consultation allows users to upload submissions, consider how these will be handled to safeguard privacy.

If you are publishing submissions on your page:

  • You need explicit consent from the organisation or individual who made the submission that it can be published.
  • Appropriate redactions should be made to safeguard personal information.
  • Check with your privacy team for guidance on redactions and to ensure your survey includes an appropriately worded question seeking consent to publish individuals' or organisations' submissions to your page.
