In NSW, licensed conveyancers are regulated by the Conveyancers Licensing Act 2003 and the Conveyancers Licensing Regulation 2015.
This proposed Regulation keeps the existing requirements for conveyancers to conduct business, with some small changes. These changes include:
the requirement to provide clients with an estimate of costs for conveyancing work if the amount is not known
the requirement to avoid conflict between duties to former and current clients
a new offence for failing to comply with conveyancers’ rules of conduct
an expanded list of offences for which penalty notices may be issued.
The proposed Regulation also includes requirements relating to fees, professional indemnity insurance, resolving costs disputes, handling trust money and recordkeeping.
Whether you’re a conveyancer, a consumer or have any other interest in these laws, we want to hear your feedback.
