Give your feedback on how the NSW Retail Leases Act operates.
The Act is a critical piece of legislation for retail tenants, landlords, investors in NSW and is designed to foster good leasing practices in the retail industry.
The NSW Small Business Commissioner has been asked to review whether the Act still meets its objectives and what changes may improve certainty and the regulatory environment for retail landlords and tenants.
What the review covers, and what it doesn't
The discussion paper gives more information that might help you to provide feedback. It sets out what the review may cover, and what it does not cover.
The review may look at a number of topics, including ways to:
cut red tape and compliance costs
make it easier to do business across state borders
clarify and simplify the Act so it's easier to know what you must do
make market information more available.
The review will not consider:
determinations of market rent and/or valuations
how regulations applied during the COVID-19 pandemic
how the NSW Civil and Administrative Tribunal operates
business and property insurance markets
how mediation services are delivered.
