Share your feedback on the remake of the Real Property Regulation

The NSW Government invites public comment on the proposed Real Property Regulation 2026.

The proposed Regulation supports the Real Property Act 1900. It remakes the current Real Property Regulation 2019 with administrative changes to improve clarity, consistency and make updates in line with current drafting standards.

The Real Property Regulation 2019 (current Regulation) supports the Real Property Act 1900 by setting out details like the requirements of certain dealings and caveats to be lodged at the land registry, the availability of information in the Torrens Register for searches, and the fees payable for titling and registry services.

The current Regulation is due to be repealed on 1 September 2026. So that the Real Property Act 1900 continues to be adequately supported, the NSW Government proposes to remake the current Regulation with administrative changes as the new Real Property Regulation 2026 (proposed Regulation).

Regulations in NSW automatically repeal after 5 years under the Subordinate Legislation Act 1989, unless postponed. Before a new Regulation can be made, public consultation on the proposed Regulation and Regulatory Impact Statement must take place.
