icare and workers' compensation independent review

What is this about?

The NSW Government has opened consultation to inform the Independent Review of Insurance and Care NSW (icare), the workers' compensation scheme and the five-year statutory review of the State Insurance and Care Governance Act 2015 (SICG Act).

The Treasurer and the Minister for Customer Service announced the Review on 4 August 2020. The review will be headed by retired Supreme Court Judge, the Hon Robert McDougall QC.

The matters in scope for the Review are:

  • A comprehensive organisational review of icare, including issues raised in the media
  • The structure and sustainability of the nominal insurer’s and treasury managed fund workers’ compensation schemes
  • The statutory review required by section 32 of the SICG Act.

The NSW Government is seeking feedback from the community and stakeholders by 4 November 2020. Your feedback should be based on the Review’s Terms of Reference.

The Review will not determine specific cases of workers' compensation or provide remediation to injured workers, but may make recommendations to improve the workers' compensation system generally and the organisations managing it.

There are several ways you can provide feedback. You can:

  • Complete a short survey
  • Send a submission by email or post

The Review may make submissions publicly available or may refer to them in the final Review report. If you would like your submission to be confidential, you should clearly indicate this and the reasons for requesting confidentiality. Please note, there may be circumstances where the Government is required by law to release the information you provide, for example under the Government Information (Public Access) Act 2009.

The Independent Reviewer may wish to interview you following your feedback. If you are willing to make yourself available to be interviewed as part of the Review, please indicate this either in your submission or through the online survey.
