Transport for NSW is seeking public comment on the draft Driving Instructors Regulation 2026 and Regulatory Impact Statement.
The Driving Instructors Act 1992 authorises and enables Transport for NSW (Transport) to require that driving instructors in NSW are fit and proper persons, trained and licensed to instruct learners on particular classes of vehicles.
The Driving Instructors Regulation 2016 supports the Act and contains provisions for:
- The types of driving instructor licences and the classes of vehicles relevant to them
- The circumstances in which a person providing driving instruction is not a driving instructor for the purposes of the Act
- Fees for licences
- The production, and improper use and care of driving instructor licences
- Records to be kept by driving schools and driving instructors
- Requirements for comprehensive motor vehicle insurance for motor vehicles used by driving instructors
- The requirement for duplicate driving controls in a driving instructor’s vehicle
Key updates of the proposed regulation will:
- provide for the display of information about reporting instructor misconduct, and
- remove lapsed provisions regarding instructor training.
Transport is proposing to remake the Regulation subject to a number of amendments and is seeking public comment on the draft Driving Instructors Regulation 2026.
The Regulatory Impact Statement seeks feedback on whether additional changes are required.
