New draft Approved Procedures (procedures) reflect recent changes in legislation for coal mine subsidence compensation in NSW.

Procedures provide a clear compensation claims process and guidance on eligibility and dispute resolution.

The draft procedures incorporate amendments made under the Coal Mine Subsidence Compensation Amendment Act 2024. They have been separated into two documents to clarify the claims processes for:

  • active coal mining areas
  • non-active coal mining areas.

Responses were collected by surveys and submissions to help Subsidence Advisory NSW understand whether the changes in legislation were clearly reflected in the draft procedures.

The 12 written submissions and 6 surveys gave a range of responses.

While community, residents, coal mining companies and industry bodies agreed on some items, a range of views were received across others.

Overall, there was broad support for the new procedures which have been separated between active and non-active mining areas.

Key stages of the claims process that are included in the draft procedures:

  • conducting pre-mining inspections in active mining areas
  • claim lodgement requirements and processes
  • assessing claimed damage
  • compensating for damage.

For active coal mining areas, changes include:

  • clarifying the roles of Subsidence Advisory NSW and coal mining companies for claims
  • clarifying independence of the claims process
  • mandatory pre-mining inspections to ensure that property owners are fairly compensated if their property is impacted by coal mine subsidence
  • pre-mining inspections to be managed by Subsidence Advisory NSW.

For active and non-active coal mining areas, changes include:

  • an additional no-cost review option introduced by Subsidence Advisory NSW to resolve disputes.
